Can my family emigrate to the UK to be with me?

Anyone who has family living abroad will have at one point or another thought about trying to get relatives to emigrate to the UK in order to be closer to them, but what is the law around this issue?

Naturally, if family members only want to come and visit for a short time, they will find it much easier than if they plan on settling in the country. Also, if your relatives are from a country within the European Economic Area (EEA) or Switzerland, the process will tend to be much simpler.

Here is a basic overview of what immigration into the UK entails.

European nationals

Individuals from an EEA country or Switzerland have the right to live and work in the UK. As a result, your partner or spouse, grandparents, children, grandchildren and children under 21 years may also move to the country. Once they have arrived, they can accept offers of work and set up a business.

These family members have an automatic right to reside here, but any other relatives need to show that they are dependent on you to qualify. The Border Agency states that people do not have to work while in the UK, but they and their family should not become a burden on public resources.

Outside the EEA

If you are from an EEA country or Switzerland but your family members are not, then they will need to apply for a residence card to stay with you in the UK. These will usually be valid for a period of five years and come in the form of a sticker in their passports.

Husbands, wives and civil partners will find it fairly simple to move to the UK with their betrothed as long as they meet certain requirements. They can apply to settle permanently after two years. If you have not married yet but plan to, then there is a six-month visa available.

In terms of children and elderly dependent relatives, people will need to apply for a visa to bring them over. You must then provide evidence that you can support them financially.

Using mobile phones while driving
