Sexual Discrimination law: paths to justice

Discrimination law applies to biasness based on sex, race, religion, disability, previous nationality, skin color, etc. This biasness may affect a victim in terms of promotion, leave application, etc. Women still face discrimination in workplace simply for being woman!

The anti-discrimination law – Revised Code (R.C) 4112 (This law covers employers with 4 or more employees), Statute Title-6 (Covers employers with more than 15 employees) and Ohio Civil Rights Act outlines guides against sexual discrimination. This law is applicable for all employers employing 4 or more permanent workers. It should be kept in mind that state and federal law is same in this context.

The 3 step process in sexual discrimination case:-

  • The victim puts forward his/her evidence of discrimination;
  • The defendant now has the chance to defend himself;
  • The victim again tries to prove that the evidence submitted by the defendant is wrong;

The victim can file the lawsuit within 6 months at Ohio Civil Rights Commission (O.C.R.C) from the date of discrimination. In case of R.C 4112, the discrimination suit is filed in a court within 6 years from the date of victimization. The law is enforced together by court and O.C.R.C.

You are eligible for injunctive relief, damages (monetary or punitive). In case of further appeal, you will approach the Court of Common Pleas, Court of Appeals and finally the Supreme Court.
